On the 1st October 2006 a significant change in fire safety legislation took place and now, as the responsible person, your failure to comply may result in a fine and/or imprisonment.
Fire certificates have been abolished and cease to have affect. However, there is now a legal requirement for a fire risk assessment to be carried out for the premises for which you are responsible.
The Fire Safety (Scotland) Regulations 2006, in conjunction with Part 3 of the Fire (Scotland) Act 2005, now comprises of the legislative element of the new fire safety regime, recently introduced in Scotland. The burden of these Fire Safety Provisions will now be that of the 'responsible persons' to ensure that a comprehensive fire risk assessment is undertaken by a competent person.
